But registering a home as your business address does not automatically mean every commercial activity may legally be carried out there. The key questions are what activity you perform, whether customers or staff attend, what the property’s authorised use permits, and whether your sector needs a communication, licence or authorisation.

1. Start with the activity, not the address

Identify the correct CAE/CIRS activity first. Portugal’s current self-employment guide points businesses to SICAE/Finanças for activity classification. Then check whether that activity has sector-specific access requirements.

A translator, software consultant or online teacher working alone from a desk is very different from opening a café, beauty salon, workshop, childcare facility, food-production kitchen or customer-facing shop at the same address.

2. A registered office is not a universal operating licence

A company can have a sede (registered office), and an independent worker has a fiscal/activity address, but the premises used for the actual activity still need to be suitable for that use. Before signing a commercial lease or converting part of a home, confirm the property’s authorised use and any municipal planning/building requirements with the relevant Câmara Municipal.

The DGE’s Área do Comerciante — Acesso à Atividade specifically brings together information on autorização de utilização, classification and starting operation of establishments.

3. If you live in an apartment, check the condominium/title

For a fraction in a condominium, check the property’s legally authorised purpose and the constitutive title/condominium rules before turning residential space into a customer-facing or disruptive business. Noise, smells, deliveries, signage, alterations and frequent customer traffic create issues that ordinary quiet home-office work normally does not.

Do not assume that “I own the apartment” means you can convert it into any commercial use without further checks.

4. Find the licence or communication for your exact activity

Portugal does not have one generic “business licence” covering every company. Requirements depend on the activity. The government’s Licences, permissions and authorisations for businesses guide and Espaço Empresa are good starting points.

The Balcão do Empreendedor is the electronic single point for many economic-activity procedures. Depending on the activity, the procedure can be a mera comunicação prévia (prior notification), an authorisation or a sector-specific licence.

5. Shops, services, restaurants and cafés

Commerce, services and restaurant/beverage activities within the RJACSR framework are handled through the Balcão do Empreendedor. The Direção-Geral da Economia provides the current access route and practical RJACSR material.

If customers will visit your home for retail, food, beauty or another regulated/customer-facing service, check the activity-specific procedure before fitting out the premises.

6. Some activities have much heavier premises rules

Food production/restaurants, industry/workshops, health activities, social-care facilities, childcare, tourism accommodation and other regulated sectors can have additional requirements involving hygiene, equipment, fire safety, accessibility, inspections or specialist authorities. A normal home office does not prove that a home is suitable for these activities.

Industrial activities have their own licensing framework; social establishments, for example, require appropriate facilities and specific operating authorisation. Use the government business-licensing guide to identify the responsible authority rather than relying on a generic checklist.

7. Signs, terraces and use of public space

Putting equipment, advertising, a terrace or other objects into public space can create separate municipal requirements. Check your Câmara and the Balcão do Empreendedor before installing anything outside the premises.

8. Renting? Get the owner’s position clear

If the premises are rented, read the lease and confirm that the intended use is compatible with it. Do not make structural alterations, install extraction systems or convert residential premises on the assumption that opening activity at Finanças gives permission to alter the property.

9. Alternatives when home is not suitable

If you mainly need an address or occasional workspace, a coworking or serviced-office arrangement may be simpler than converting a home. Common providers operating in Portugal include Regus, Spaces and local independent coworking centres. Confirm exactly what the package permits: workspace access, mail handling and use as a company registered office are different services.

10. Practical checklist

Confirm the correct CAE/CIRS activity.

Decide whether the address is merely administrative or where the activity actually operates.

Check the property’s authorised use and municipal rules.

If applicable, check the lease, constitutive title and condominium implications.

Search the activity in gov.pt/Balcão do Empreendedor for licensing or notification requirements.

Check sector rules for food, industry, health, childcare, tourism or other regulated activities.

Check signage/public-space and alteration requirements before spending money.

Only then sign a long commercial lease or pay for a major fit-out.

Useful links

gov.pt — licences, permissions and authorisations for businesses

Espaço Empresa

Balcão do Empreendedor

Área do Comerciante — access to activity

DGE — commerce, services and restaurants

Last verified: 2 October 2026.
