This guide gives small businesses a practical route from deciding to hire to running the first payroll.

1. Before you offer the job

Define the role, workplace/remote arrangement, hours, salary and intended contract type.

Budget for more than gross salary: employer Social Security, occupational-accident insurance, holiday/Christmas subsidies and other employment costs.

Check whether a collective bargaining agreement (instrumento de regulamentação coletiva) applies to your activity.

Check current IEFP hiring incentives before finalising the hire: eligibility and application timing matter.

In 2026 the mainland national minimum monthly wage is €920. A higher sector/collective-agreement minimum can apply.

2. Choose the contract carefully

Portuguese employment law distinguishes indefinite (sem termo), fixed-term (a termo certo), uncertain-term (a termo incerto), part-time and other arrangements. Fixed-term employment is not simply a flexible default: it needs a legally valid temporary justification and the written contract should state the relevant facts.

Do not label someone a freelancer merely to avoid employment obligations. If the reality is employment, using recibos verdes does not automatically make the relationship genuinely self-employed.

3. Put the employment terms in writing

Even where the law does not make a particular employment contract form mandatory, employers have extensive written information duties. In practice, use a proper written contract. Cover the parties, role/category, workplace, start date, working time, pay, applicable collective agreement, holidays, notice/probation information and any lawful fixed-term justification.

For contract drafting or unusual clauses, use an employment lawyer or qualified HR professional rather than copying a generic internet template.

4. Register the worker with Social Security

The employer must communicate admission through the Social Security portal. Under the current 2026 rules, admission is generally communicated during the 15 days before activity begins. Limited cases involving very-short-duration contracts or shift work can be communicated within 24 hours after activity begins.

See the government’s official admission service for the current procedure and exceptions.

5. Hiring a foreign worker

A foreign worker does not need to wait for a NISS before signing the employment contract or starting work. In February 2026 the government/AIMA expressly clarified that the contract is fundamental evidence for obtaining the NISS and the NISS need not appear in the contract. Once the NISS is issued, the employer must communicate the employment link through Social Security.

That does not remove immigration/right-to-work requirements. Check the person’s lawful position separately where applicable. See AIMA’s 2026 clarification.

6. Payroll and Social Security

Set up payroll before the first payday. For ordinary employees, the standard general Social Security split is normally 23.75% employer + 11% worker, although special categories can have different rates. The employer withholds the employee share and pays the required contributions.

Payroll must also handle IRS withholding where applicable, holiday and Christmas subsidies, payslips, absences and other statutory items. A contabilista certificado or payroll provider can handle much of the process, but the employer remains responsible for compliance.

7. Insurance and workplace safety

Occupational-accident insurance (seguro de acidentes de trabalho) is mandatory. Arrange cover from the start of employment. Employers must also organise occupational health and safety appropriate to the business, including risk prevention, information/training and occupational-health arrangements.

Use the government’s current workplace health and safety guide and ACT for official labour information.

8. Recruitment and payroll providers

You can recruit directly through IEFPonline, LinkedIn, Indeed and Portuguese job sites, or use established recruiters such as Randstad Portugal, Adecco Portugal and Hays Portugal. For payroll, ask your accountant whether they provide payroll internally before adding another platform/provider.

Provider links are examples, not endorsements. Compare fees, contract terms and the provider’s legal role.

9. Check hiring incentives before hiring

IEFP incentives change and often have strict eligibility windows. As of 2 October 2026, applications for the current +Emprego and Emprego +Talento rounds are open until 15 December 2026 unless funding closes earlier. +Emprego’s current base support is 12 IAS (€6,445.56 in 2026), while Emprego +Talento targets qualifying higher-educated young people and has different support. Do not assume a future hire will qualify: check the live IEFP conditions first.

10. First-hire checklist

Calculate the full employment cost, not only salary.

Check the correct contract and any collective agreement.

Check IEFP support before committing if you hope to claim it.

Sign a compliant written contract.

Arrange occupational-accident insurance and workplace health/safety.

Communicate admission to Social Security within the applicable deadline.

Set up payroll, IRS withholding and Social Security contributions.

Give the employee the required employment information and maintain personnel/payroll records.

Useful official links

gov.pt — communicate employee admission

gov.pt — employer Social Security obligations

ACT — labour authority

IEFP — current hiring incentives

AIMA — foreign workers and NISS (2026)

Last verified: 2 October 2026.
