It is separate from the tax on your income or company profit: a freelancer may pay IRS and deal with IVA, while a company may pay IRC and deal with IVA. Whether you actually charge IVA depends on your activity, exemption status, customer and where the transaction is treated as taking place.

Fast orientation: on mainland Portugal the main IVA rates are 6%, 13% and 23%. A qualifying Portugal-established small business can use the Article 53 exemption where the previous year’s annual domestic turnover did not exceed €15,000, subject to the statutory conditions. Exemption means you normally do not charge IVA on covered sales, but you also lose the normal right to deduct input IVA connected with them.

1. IVA is not the same as IRS or IRC

IVA is a transaction/consumption tax.

IRS taxes an individual’s income, including Category B independent income.

IRC generally taxes company profits.

Being exempt from IVA does not make your business income tax-free. Likewise, paying IRS or IRC does not tell you whether an invoice should contain IVA.

2. Mainland IVA rates

Rate

General use

6%

Reduced rate for goods/services in List I of the IVA Code.

13%

Intermediate rate for goods/services in List II.

23%

Standard rate for other taxable supplies.

Do not choose a rate because a product or service “sounds essential”. Classification follows the IVA Code and its lists. The Azores and Madeira can apply lower regional rates, so a mainland rate table should not simply be copied to an operation treated as taking place in an autonomous region.

Autoridade Tributária — CIVA Article 18 (rates)

3. Article 53 small-business exemption

Article 53 currently exempts qualifying taxable persons established or domiciled in Portugal whose annual turnover in Portuguese territory in the previous calendar year did not exceed €15,000, provided the other statutory conditions are met. For someone starting activity, the relevant turnover is the estimate for the current calendar year.

Under the exemption you generally do not charge IVA on covered transactions and cannot deduct input IVA in the normal way. Your invoice must use the legally appropriate exemption wording rather than showing IVA as if you were in the normal regime.

€15,000 is not a universal “freelancer pays no VAT” rule. Article 53 has conditions and exclusions, and cross-border transactions can create separate obligations. Check the exact transaction when you have EU customers/suppliers, imports, exports or unusual activities.

Autoridade Tributária — CIVA Article 53

4. What if you cross the exemption threshold?

Do not wait until the next annual tax return and assume nothing changes. Article 53 interacts with Articles 54 and 58, including rules for leaving the exemption and cases where the threshold is exceeded materially during the year. If turnover is approaching or has crossed the limit, check your current Finanças classification promptly and obtain accounting advice before issuing further invoices.

5. Normal IVA regime: output IVA and input IVA

In the normal regime, a business generally charges output IVA on taxable sales and may deduct eligible input IVA paid on business purchases. The periodic return calculates the position. Not every expense gives a deduction and exempt/mixed activities can restrict deduction, so “I paid IVA, therefore I get it all back” is not a safe assumption.

6. Invoices and receipts

Your invoice should reflect your actual IVA treatment: taxable rate, legal exemption basis, reverse-charge wording or other applicable rule. Independent workers using Portal das Finanças should distinguish fatura, recibo and fatura-recibo. See our recibos verdes guide and opening activity at Finanças guide.

7. Periodic IVA returns

Under current Article 41, businesses with prior-year turnover of €650,000 or more generally submit monthly periodic returns. Those below €650,000 generally submit quarterly returns and can opt for monthly filing under the statutory procedure.

Monthly: by the 20th day of the second month after the month concerned.

Quarterly: by the 20th day of the second month after the quarter concerned.

June monthly returns and second-quarter returns have the special statutory deadline of 20 September.

Payment deadlines are related but should be checked separately in the current tax calendar rather than inferred from the return deadline.

Autoridade Tributária — CIVA Article 41

8. Selling services to an EU business

For many ordinary B2B services supplied from Portugal to a VAT-registered business in another EU country, Portuguese IVA is not charged and the customer accounts for VAT through the reverse-charge mechanism. But place-of-supply exceptions exist, so first classify the service and customer correctly.

Validate an EU customer’s VAT number using VIES and retain evidence of the validation. An invalid VIES result can mean the number does not exist, is not activated for intra-EU transactions or registration is not yet final.

9. Selling goods to an EU business

Where goods are dispatched to another EU country to a customer with a valid EU VAT number, the supply can generally be made without Portuguese IVA under the intra-EU rules, provided the legal requirements and evidence are satisfied. If the customer does not have a valid EU VAT number, domestic VAT treatment may apply instead. Keep transport and customer-status evidence.

10. Selling to EU consumers: B2C and OSS

B2C cross-border rules are different. For EU distance sales of goods and certain cross-border consumer services, destination-country VAT can apply. The EU has a common €10,000 threshold for specified intra-EU distance sales/TBE supplies, subject to the detailed rules.

The One Stop Shop (OSS) can let a Portuguese business register through one portal, charge the customer’s destination-country VAT where required, submit one OSS return and make one payment that is distributed to the relevant EU countries. OSS does not mean every B2C service automatically uses destination VAT; the underlying place-of-supply rule still comes first.

Your Europe — VAT One Stop Shop

11. Customers and suppliers outside the EU

Exports of goods outside the EU are generally not charged with EU VAT when the conditions/evidence are met. Services supplied to non-EU business customers also commonly fall outside Portuguese IVA, but exceptions and use-and-enjoyment/place-of-supply rules can matter. Imports of goods generally face import IVA, while business services bought from abroad can require Portuguese reverse-charge accounting.

12. Buying from abroad

Cross-border IVA is not only about sales. Buying goods from another EU country can create an intra-Community acquisition that you account for in Portugal. Buying business services from an EU or non-EU supplier can require reverse-charge/self-assessment. This can matter even when a supplier’s invoice shows no VAT.

13. Article 53 and cross-border business

Small-business exemption rules changed at EU level from 2025. Article 53 now also contains rules for qualifying businesses established in other EU Member States, including an EU-wide €100,000 turnover condition and an EX identification mechanism. A Portugal-established SME seeking small-business exemption in other Member States likewise needs to follow the cross-border SME scheme. Do not confuse that €100,000 EU-wide condition with Portugal’s €15,000 domestic Article 53 threshold.

14. When you should use an accountant

Get professional help early if you have mixed exempt/taxable activities, property transactions, imports/exports, regular EU B2B trade, EU consumer sales, OSS/IOSS, multiple establishments, partial deduction, significant capital purchases or uncertainty about place of supply. A small mistake repeated across hundreds of invoices is much harder to repair than getting the classification right first.

Common mistakes

Thinking Article 53 means the income itself is tax-free.

Charging 23% automatically without checking whether a reduced/intermediate rate applies.

Assuming every foreign customer means “no IVA”.

Using reverse charge without validating the customer’s status or transaction.

Ignoring IVA on services purchased from foreign suppliers.

Failing to preserve VIES/transport/export evidence.

Assuming exempt businesses can recover all IVA on purchases.

Crossing the Article 53 threshold and continuing to invoice as before without checking the transition rules.

Confusing the periodic-return deadline with the separate payment deadline.

Practical IVA checklist

Confirm your IVA regime in Portal das Finanças.

Classify the product/service and applicable rate or exemption.

Identify whether the customer is B2B or B2C and where they are established.

For EU B2B, validate VAT numbers in VIES where relevant.

Put the correct IVA/exemption/reverse-charge information on the invoice.

Keep purchase invoices and cross-border evidence.

Track turnover against Article 53 and other relevant thresholds.

Submit periodic/recapitulative/OSS declarations where applicable.

Check the current tax calendar for payment dates.

Official links

Autoridade Tributária — CIVA Article 53

Autoridade Tributária — CIVA Article 18 rates

Autoridade Tributária — CIVA Article 41 periodic returns

European Commission — VIES VAT-number validation

Your Europe — cross-border VAT

Your Europe — OSS

Last verified: 2 October 2026.
