If something goes wrong with a Dutch rental, do not start with the question “Do I need a lawyer?” Start with what kind of problem is this? Excessive rent, defects, service costs, deposit disputes, intimidation and fraud use different enforcement routes.
Choose the right route
| Problem | First step | Possible next route |
|---|---|---|
| Rent seems too high | Run the Huurcommissie Huurprijscheck and save the WWS calculation | Huurcommissie where the statutory procedure applies; legal advice/kantonrechter where needed |
| Mould, leak, heating or another defect | Report it in writing to the landlord with evidence | Huurcommissie for qualifying rent/defect procedures; municipality for enforcement issues; court for orders/damages where appropriate |
| Service-cost bill is unclear | Ask for the annual settlement, calculation and supporting records | Huurcommissie or court depending on the tenancy and dispute |
| Deposit not returned | Demand repayment in writing and state the statutory deadline | Kantonrechter if necessary; municipal reporting point if landlord conduct breaches good-landlord rules |
| Intimidation, discrimination or prohibited landlord behaviour | Save messages, dates and witnesses | Municipal Good Landlordship reporting point; discrimination service/police where relevant; legal help |
| Suspected fake listing/fraud | Do not transfer money; verify identity and authority to rent | Bank/payment provider and police quickly if money was sent |
Build an evidence file
- Contract, advertisement and WWS points calculation.
- Check-in report, inventory and dated photos/video.
- Bank statements and deposit/payment proof.
- Emails, WhatsApp messages and letters.
- Photos of defects over time, including dates.
- Service-cost statements and invoices supplied by the landlord.
- A short timeline of what happened and when.
Do not simply stop paying rent
A serious defect does not automatically give a tenant permission to invent their own rent reduction or stop paying. Use the proper defect/rent-reduction procedure or obtain legal advice. Unilateral non-payment can create a second dispute about arrears.
Useful legal help
Use the Juridisch Loket if you qualify for its personal legal help, the municipality’s tenant/Good Landlordship reporting route, the Huurcommissie for its statutory rental procedures, and the kantonrechter when a court decision is needed. Our Legal & Rights section explains these routes in more detail.
