A Dutch rental dispute does not have one universal complaints desk. The correct route depends on whether the issue is rent, service costs, defects, termination, harassment, a deposit or another contractual dispute.
Huurcommissie
The Huurcommissie is independent and deals with specified disputes between tenants and landlords, including qualifying disputes about rent, rent increases, service costs and defects. For serious defects, a qualifying procedure can lead to a temporary rent reduction until the problem is repaired.
Municipality and landlord behaviour
Municipalities also have enforcement responsibilities in parts of rental law. Keep a written record of intimidation, unlawful charges, registration problems and other conduct and check the municipality’s rental-reporting route where applicable.
Kantonrechter
Rental cases fall within the kantonrechter’s jurisdiction regardless of the monetary amount, and an advocaat is not compulsory. Court may be the relevant route where the Huurcommissie cannot decide the issue or where a binding civil judgment is needed.
2027 service-cost change
The Wet modernisering servicekosten takes effect on 1 January 2027 and changes service-cost rules, particularly for new contracts, while also changing some procedures for existing contracts. Any guide used after that date should be rechecked.
