Portugal’s business-tax vocabulary is easier once you separate three different questions. IVA is VAT on transactions. IRS is personal income tax and normally covers a sole trader or independent worker’s Category B income. IRC is corporate income tax and normally applies to a Portuguese company such as an Lda. They are not three alternative regimes from which you simply choose one.
Which tax applies to which business?
| Situation | Income/profit tax | IVA |
|---|---|---|
| Trabalhador independente / freelancer | Usually IRS Category B | Check whether the transaction is taxable, exempt or subject to cross-border rules |
| ENI operating in own name | Usually IRS Category B | Same separate IVA analysis |
| Portuguese Lda./Unipessoal Lda./S.A. | Usually IRC on taxable company profit | Company may charge/account for IVA on taxable supplies |
The legal form therefore affects the income-tax framework, but it does not make VAT disappear. A company can owe IRC and collect IVA; an independent worker can owe IRS and collect IVA.
IVA: Portugal’s VAT
IVA (Imposto sobre o Valor Acrescentado) is charged on many supplies of goods and services. On the mainland the current rates are 23% normal, 13% intermediate and 6% reduced. The autonomous regions have lower rates: Madeira 22% / 12% / 4% and Azores 16% / 9% / 4%. The correct rate depends on what you sell and where the transaction is treated as taking place; do not choose a reduced rate merely because it seems similar to another product or service.

The €15,000 Article 53 small-business exemption
Article 53 of the IVA Code provides a small-business exemption. For a taxpayer established/domiciled in Portugal, the current threshold is €15,000 annual turnover in Portuguese territory in the previous calendar year, subject to the other statutory conditions. The 2025 reform also created rules for qualifying businesses established in another EU Member State, including a €100,000 EU-wide turnover ceiling and the required EX identification procedure.
Being below €15,000 does not mean every person and every transaction is automatically exempt. Activity type, establishment, exports and other statutory conditions matter. Some activities can instead be exempt by their nature under Article 9, including specified health, education and other services.
IVA returns: monthly or quarterly
If you are in the normal IVA regime, you generally submit periodic returns even for a period in which you issued no invoices. The current turnover dividing line is €650,000: below it the default is quarterly; at or above it the regime is monthly. A taxpayer below the threshold can opt for monthly filing and is generally bound by that option for three years.
The IVA Code currently states that periodic returns are submitted by the 20th day of the second month following the relevant month or quarter. Because government explanatory pages can lag statutory amendments, use the current IVA Code/Portal das Finanças calendar when an exact deadline matters.

Foreign and EU clients: do not automatically add Portuguese IVA
Cross-border VAT is one of the easiest areas to get wrong. The answer depends on whether the customer is a business or consumer, where each party is established, the type of service or goods, and the applicable place-of-supply rules. A Portuguese consultant invoicing a VAT-registered business in another EU country can face different invoicing and reporting treatment from the same consultant selling to a private consumer.
For qualifying services to businesses elsewhere in the EU, the Portuguese supplier may have to submit a recapitulative statement (declaração recapitulativa / Modelo 8). Current gov.pt guidance also warns that this reporting can still be relevant to a worker using the Article 53 exemption. For non-EU clients, check the place-of-supply and invoicing rules rather than assuming “foreign = zero VAT”.
IRS for independent workers and sole traders
A person working independently in their own name normally declares the activity under Category B of IRS. The two broad ways of determining taxable business/professional income are the simplified regime and organised accounting (contabilidade organizada).
Under the simplified regime, tax is not calculated by simply treating 100% of every invoice as taxable profit. Article 31 applies statutory coefficients to different types of gross income. Important examples include:
- 0.15 for sales of goods/products and specified hotel/restaurant-type income;
- 0.75 for professional activities specifically listed under Article 151;
- 0.35 for service income not covered by the preceding categories;
- other coefficients apply to particular income such as subsidies, intellectual-property-related income, capital/property income attributable to the activity and certain related-company services.
The coefficient is not your IRS tax rate. It helps determine the amount of Category B income entering the IRS calculation; the person’s overall IRS position, deductions and applicable rates still matter.

Organised accounting
Organised accounting uses accounting records and tax rules to determine the result rather than relying on the simplified coefficients. It also brings greater bookkeeping and compliance requirements and normally requires a certified accountant (contabilista certificado). Depending on turnover and circumstances it can be mandatory; it can also be chosen voluntarily. If your costs are substantial, the simplified regime is not automatically the cheapest merely because it is simpler.
IRS withholding is an advance payment, not a second tax
Some Category B payments are subject to retenção na fonte when the payer is an entity required to withhold. The current Article 101 rate for income from the specifically listed Article 151 professional activities is 23%; other Category B categories can use different rates, including 11.5% or 16.5% in the cases specified by law.
Withholding is generally an advance against the eventual IRS bill. It should not be confused with the simplified-regime coefficient: a 0.75 coefficient and a 23% withholding rate describe completely different parts of the tax system.

IRC for Portuguese companies
An Lda., Unipessoal Lda. or S.A. normally falls within IRC (Imposto sobre o Rendimento das Pessoas Coletivas). IRC is based on the company’s taxable profit under corporate tax/accounting rules, not simply its turnover.
For 2026, the current general mainland IRC rate in Article 87 is 17%. Qualifying SMEs and Small Mid Caps carrying on an agricultural, commercial or industrial activity can apply 15% to the first €50,000 of taxable profit, with the general rate applying to the excess, subject to the statutory conditions including applicable EU de minimis rules.
Municipal derrama, autonomous taxation, regional rates, tax benefits and other adjustments can change a company’s final tax burden. The headline IRC rate is therefore not the same thing as “the company pays exactly 17% of its accounting profit”.

What can the business deduct?
Do not mix three different concepts: an IRS simplified coefficient, a deductible business expense for income-tax/accounting purposes, and deductible input IVA. They follow different rules. A cost can be real and business-related without automatically producing the VAT deduction or tax treatment you expected.
Keep proper invoices in the business/taxpayer name and maintain records. For a company or organised-accounting business, your accountant should classify expenses. For IVA, input-tax deduction has specific restrictions; for example, the IVA Code limits deductions for various passenger-vehicle, travel, accommodation, food/drink and luxury expenses, with exceptions and sector-specific rules.
A practical compliance calendar
- Before starting: register/open activity correctly and choose the right tax/accounting setup.
- Every sale/payment: issue the correct invoice, invoice-receipt or receipt and apply the correct IVA/withholding treatment.
- Monthly/quarterly where applicable: file IVA and cross-border declarations on the correct cycle.
- Independent workers: remember that Social Security reporting/contributions are separate from IRS and IVA.
- Annually: independent workers report Category B through IRS; companies complete their IRC/accounting obligations.
- Whenever the business changes: update activity codes, turnover estimates, IVA regime, address or other registration details when legally required.
Common mistakes
- Thinking Article 53 means “tax free” rather than an IVA exemption.
- Confusing the 0.75 simplified coefficient with a 75% tax rate.
- Treating IRS withholding as the final IRS calculation.
- Adding 23% Portuguese IVA automatically to every foreign client.
- Assuming an Lda. pays tax on turnover instead of taxable profit.
- Using an old IRC rate without checking the tax year.
- Spending IVA collected from customers as though it were business revenue.
- Assuming every business expense gives a full input-IVA deduction.
- Ignoring nil IVA returns while registered in the normal regime.
When should you use an accountant?
A certified accountant is essential where organised accounting/company rules require one, but professional help can be worthwhile earlier. Get advice before choosing between self-employment and a company if profits are meaningful, if you have employees, substantial expenses, multiple owners, foreign income/clients, e-commerce, property, vehicles, investment income or activity in more than one country. Tax residency and permanent-establishment questions should not be solved from a generic rate table.
